Revolution Analytics Technical Support Portal Terms of Use


Revolution is allowing its customers to submit error reports, requests for technical support and other support related inquiries (“Support Requests”) through an online service (the “Service”).   In order to comply with our contract with the vendor providing the Service, your agreement to the following terms (the “Terms”) is required.  If you are unable to agree with the Terms, you can continue to submit Support Requests through email and the telephone.

  1. You agree not to:

    (a)    license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit or make the Service available to any third party;

    (b)   use the Service other than for your internal business purposes;

    (c)    use the Service to process data on behalf of any third party;

    (d)   modify, adapt, or hack the Service or otherwise attempt to gain unauthorized access to the Service or related systems or networks;

    (e)   use the Service in any unlawful manner, including but not limited to violation of any person’s privacy rights;

    (f)     use the Service to send unsolicited or unauthorized junk mail, spam, pyramid schemes or other forms of duplicative or unsolicited messages;

    (g)    use the Service to store or transmit files, materials, data, text, audio, video, images or other content that infringes on any person’s intellectual property rights;

    (h)   use the Service in any manner that deliberately or negligently interferes with or disrupts the integrity or performance of the Service and its components;

    (i)      attempt to decipher, decompile, reverse engineer or otherwise discover the source code of any software making up the Service;

    (j)     use the Service to knowingly post, transmit, upload, link to, send or store any content that is unlawful, racist, hateful, abusive, libelous, obscene, or discriminatory;

    (k)    use the Service to store or transmit any “protected health information” as that term is defined in 45 C.F.R. 160.103;

    (l)      use the Service to knowingly post, transmit, upload, link to, send or store any viruses, malware, Trojan horses, time bombs, or any other similar harmful software;

    (m)    share a login among multiple individuals or disclose any login information.

  2. You are responsible for compliance with the provisions of these Terms by anyone using the Service within your organization.
     
  3. Transmission of personally identifiable information and your confidential information through the Services is at your own risk.
     
  4. You acknowledge that the vendor providing the Service, Zendesk, Inc.,  may collect certain information about you as well as your devices, computers and use of the Service.  Zendesk uses, discloses, and protects this information as described their Privacy Policy, the then-current version of which is available at www.zendesk.com/privacy and is incorporated into the Terms.
     
  5. You will indemnify and hold Zendesk and Revolution Analytics harmless, from and against any claim against Zendesk or Revolution Analytics brought by a third party alleging that the data you submit through the Service or your use of the Service in a manner that is prohibited hereunder infringes or misappropriates such third party’s valid patent, copyright, trademark or trade secret or other intellectual or proprietary rights.
     
  6. These Terms shall be governed by the laws of the State of California without regard to conflict of laws principles. You hereby expressly agree to submit to the exclusive personal jurisdiction of the federal and state courts of the State of California, Santa Clara County, for the purpose of resolving any dispute relating to the Terms or access to or your use of the Service.
